The Services are intended for users within Kenya and elsewhere only where permitted by law. Information provided through Shift is not intended for distribution in any jurisdiction where doing so would violate local laws. If you access the Services from outside Kenya, you are responsible for compliance with local regulations. Shift is a subscription-based real estate marketplace: property owners pay advertisement fees to list properties, and seekers pay a subscription to search & contact owners — no agents are involved in transactions.
Our intellectual property: All Content on Shift (including source code, databases, design, text, graphics, logos, and Marks) is owned or licensed by Shift and protected by Kenyan and international copyright, trademark, and other laws.
Your use license: We grant you a limited, non-exclusive, non-transferable, revocable license to access the Services and print content for personal, non-commercial use, subject to these Terms. Any commercial exploitation, copying, or resale of our Content or Marks is prohibited without our prior written consent. For permissions, contact info@shift.ke.
Submissions: Any feedback, ideas, or suggestions you send to us (“Submissions”) become our property, and we may use them freely without compensation. You warrant that your Submissions are original, lawful, and do not infringe third-party rights.
By using Shift, you represent that: (1) you have legal capacity to accept these Terms; (2) you are at least 18 years old; (3) you will not use automated means to access the Services; (4) your use will comply with all applicable laws; and (5) all information you provide is accurate and complete. Providing false information may result in immediate termination of your account.
You may not use Shift for any purpose other than its intended function (direct property listing & searching). Prohibited actions include, but are not limited to:
Shift may allow you to submit property listings, reviews, photos, or other content (“Contributions”). When you post Contributions, you represent that you own or have necessary rights, and that your Contributions are accurate, not deceptive, and comply with applicable laws. You are solely responsible for any Contributions you make.
By posting Contributions, you grant Shift a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute your content in connection with operating the Services. You retain full ownership of your Contributions. However, we may remove or modify any Contribution at our discretion.
We reserve the right to monitor the Services, enforce these Terms, and take legal action against violators. We may also limit or disable any user’s access, remove content, or manage the platform to protect our rights and ensure proper functioning. We are not obligated to take any specific action.
These Terms remain in effect while you use Shift. We may, in our sole discretion, suspend or terminate your account and access to the Services at any time, without notice, for any reason (including breach of these Terms). Upon termination, your right to use the Services ends immediately. You may not re-register under a false identity.
We may modify, update, or discontinue any part of the Services at any time without liability. We do not guarantee uninterrupted availability; there may be downtime for maintenance, upgrades, or unforeseen issues. Shift is not liable for any inconvenience or loss caused by such interruptions.
These Legal Terms are governed by the laws of the Republic of Kenya. You irrevocably consent to the exclusive jurisdiction of the courts of Kenya for any disputes arising from these Terms or your use of the Services.
Informal Negotiations: Before initiating any formal dispute, parties shall attempt to resolve matters informally for at least 60 days. Binding Arbitration: Any unresolved dispute arising out of these Terms shall be referred to and finally resolved by the International Commercial Arbitration Court under the European Arbitration Chamber (Belgium), with rules of the ICAC, and the arbitration shall be held in Meru, Kenya, with 3 arbitrators and proceedings in English/Swahili. Exceptions: Claims related to intellectual property, theft, privacy, or injunctive relief may be brought in court.
There may be typographical errors or inaccuracies in property listings, pricing, or descriptions. Shift reserves the right to correct such errors without prior notice.
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” SHIFT MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE ACCURACY, RELIABILITY, OR AVAILABILITY OF THE SERVICES. WE DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE ARE NOT RESPONSIBLE FOR ANY INTERACTIONS OR TRANSACTIONS BETWEEN USERS. YOU USE THE SERVICES AT YOUR OWN RISK.
TO THE FULLEST EXTENT PERMITTED BY LAW, SHIFT AND ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE LESSER OF: (A) THE AMOUNT YOU PAID US (IF ANY) OR (B) KES 10,000. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.
You agree to defend, indemnify, and hold harmless Shift and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from: (1) your use of the Services; (2) your breach of these Terms; (3) your Contributions or interactions with other users; or (4) violation of any third-party rights. We reserve the right to assume exclusive defense of any matter subject to indemnification, at your expense.
We maintain certain data related to your use of Shift, but you are solely responsible for your content and activity. While we perform routine backups, we are not liable for any loss or corruption of data. You waive any claims against Shift arising from such loss.
By using Shift, you consent to receive electronic communications (emails, in-app notifications). All agreements, notices, and disclosures we send electronically satisfy any legal writing requirement. You agree to use electronic signatures and records for any transactions facilitated via the Services.
These Terms constitute the entire agreement between you and Shift. Our failure to enforce any right does not waive that right. If any provision is found invalid, the remainder remains in effect. No joint venture, partnership, or agency is created by these Terms. You may not assign your rights without our consent.

By continuing to use Shift, you acknowledge that we are not a party to any rental or sale transaction; all agreements are solely between property owners and seekers. Perform your own due diligence.
